MonIA — Terms of Use & End User License Agreement (EULA)

By downloading, installing or using the App, you agree to these Terms of Use and End User License Agreement (the "Terms"). If you do not agree, do not use the App and request a refund through Apple.

These Terms supplement Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA", apple.com/legal/.../stdeula). For any point not addressed here, the Apple Standard EULA applies. Where these Terms expressly cover a point, they prevail to the extent permitted by law.

1. License

The App is licensed, not sold, to you. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on any Apple-branded device you own or control, in accordance with the Usage Rules of the Apple Media Services Terms and Conditions. You may not redistribute, sublicense, rent, lease, lend or resell the App, nor reverse engineer, decompile or disassemble it, except to the extent such a restriction is prohibited by applicable law.

2. One-time purchase

The App is offered as a one-time purchase through the App Store. There is no subscription, no recurring fee and no in-app purchase in this version. Purchase, billing and refunds are handled by Apple under the Apple Media Services Terms and Conditions. Future updates, if any, are provided at our discretion.

3. Nature of the service — AI-generated content

The App runs a large language model locally on your device to generate text. You acknowledge and accept that:

You are solely responsible for any decision or action taken on the basis of the App's outputs.

4. No professional advice

The App does not provide professional advice. Its outputs are not a substitute for medical, legal, financial, tax, psychological or any other regulated professional advice. Always consult a qualified professional for such matters. Do not use the App in situations where inaccurate output could lead to injury, loss or harm, including medical emergencies.

5. System requirements

The App requires, at minimum, an iPhone 15 Pro or newer, with 8 GB of RAM and iOS 26 or later. The App relies on Apple Silicon and a raised memory limit to run the model on device; it may not install, launch or function correctly on unsupported devices. We are not responsible for the App's unavailability or degraded behaviour on devices that do not meet these requirements.

6. Battery use and device temperature

Running an AI model locally is computationally intensive. During prolonged use you should expect higher battery consumption and noticeable device warming. This is normal behaviour for on-device inference and is not a defect of the App. Use the App reasonably and discontinue use if your device becomes uncomfortably warm. Precision mode is more demanding than Standard and may increase this warming.

7. Privacy and data

The App is designed to work 100% on your device. We do not collect, transmit or store your personal data, conversations or documents on any server. Network access is used only to download the on-device AI models: the Standard model (about 1.7 GB, downloaded once after installation) and, if you choose to enable it, Precision mode (about 3 additional GB, downloaded only at your request), both via Apple's delivery system (Background Assets) (plus standard App Store / system operations); Wi-Fi is recommended for these downloads. After this, the App works fully offline. Photo and document analysis is performed locally. See our Privacy Policy for full details.

8. Acceptable use

You agree not to use the App: (a) for any unlawful purpose or in breach of any applicable law; (b) to generate or distribute content that is illegal, harmful, infringing, or that violates the rights of others; (c) to attempt to circumvent the App's technical limitations or safety behaviour. You are responsible for the content you input and for how you use the outputs.

9. Languages and translations

The App interface, in-app text and these Terms may be translated using artificial-intelligence tools. Translations may contain errors or inaccuracies. If there is any discrepancy or ambiguity, the French version of these Terms prevails. To report a translation error in the App or in the legal documents, contact us at support@monia.info.

10. Open-source components

The App incorporates third-party open-source software licensed under the Apache License 2.0 and the MIT License, including the Qwen model weights and Apple's MLX libraries. Your use of these components is subject to their respective licenses. Complete attribution and license texts are available in the App (Settings → About / Credits) and online: Open-Source Notices.

11. Intellectual property

The App, its user interface, original code, name and visual assets are owned by the Publisher or its licensors and protected by intellectual-property laws. The AI model and open-source libraries remain the property of their respective owners under their licenses (Section 10). No rights are granted other than the limited license in Section 1.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that outputs will meet your expectations. Nothing in this section limits the mandatory legal guarantees owed to consumers (see Section 15).

13. Limitation of liability

To the maximum extent permitted by applicable law, the Publisher shall not be liable for any indirect, incidental, special or consequential damages, loss of data, loss of profit, or any damage resulting from (a) reliance on the App's outputs, (b) battery wear, heat or device behaviour described in Section 6, or (c) your inability to use the App on an unsupported device. This limitation does not exclude or limit our liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, for fraud, or for the mandatory rights of consumers.

14. Apple App Store — specific terms

Because the App is distributed via the Apple App Store, the following apply:

15. Consumer rights (EU / France)

If you are a consumer in the European Union, you benefit from mandatory legal guarantees, including the legal guarantee of conformity (in France, garantie légale de conformité, articles L.217-1 et seq. of the Code de la consommation) and the guarantee against hidden defects (garantie des vices cachés). Nothing in these Terms limits or excludes these mandatory rights. Purchase, billing and refunds for the App are operated by Apple via the App Store.

16. Changes to these Terms

We may update these Terms to reflect changes to the App or to legal requirements. The current version is identified by its date and version number above. Material changes will be made available with the App or at the URL where these Terms are published. Continued use after an update constitutes acceptance, without prejudice to your mandatory consumer rights.

17. Governing law and jurisdiction

These Terms are governed by French law, without prejudice to the mandatory consumer-protection provisions of your country of habitual residence within the EU. Any dispute relating to the App or these Terms shall be subject to the jurisdiction of the competent French courts, subject to the mandatory rules of consumer jurisdiction that allow a consumer to bring proceedings before the courts of their place of residence. The EU Online Dispute Resolution platform (formerly at ec.europa.eu/consumers/odr) was closed on 20 July 2025 (Regulation (EU) 2024/3228).
